Het verloop van het geding in hoger beroep
SKO is bij exploot van 8 juni 2010 in hoger beroep gekomen van het vonnis van de rechtbank Alkmaar, sector kanton, locatie Hoorn (verder: de kantonrechter) van 29 maart 2010, onder zaak- en rolnummer 285613\CV EXPL 08-5034 gewezen tussen [ Geïntimeerde ] als eiseres en SKO als gedaagde.
Bij memorie heeft SKO zes grieven aangevoerd, een productie overgelegd, bewijs aangeboden en geconcludeerd dat het hof bij uitvoerbaar bij voorraad verklaard arrest het bestreden vonnis zal vernietigen en, opnieuw rechtdoende, de vorderingen van [ Geïntimeerde ] alsnog zal afwijzen, [ Geïntimeerde ] zal veroordelen tot terugbetaling aan SKO van een bedrag van € 1.242,44 ter zake van ingevolge het bestreden vonnis betaalde proceskosten, met de wettelijke rente daarover vanaf de dag van betaling, en [ Geïntimeerde ] zal veroordelen in de kosten van het geding in beide instanties, vermeerderd met de wettelijke rente daarover vanaf veertien dagen na het arrest, alsmede in de nakosten.
[ Geïntimeerde ] heeft hierop geantwoord, producties overgelegd, bewijs aangeboden en geconcludeerd, kort gezegd, dat het hof bij uitvoerbaar verklaard arrest het bestreden vonnis zal bekrachtigen, met verwijzing van SKO in de kosten van – begrijpt het hof - het hoger beroep, vermeerderd met de wettelijke rente vanaf veertien dagen na het arrest, alsmede in de nakosten.
Vervolgens heeft SKO onder overlegging van producties een akte uitlating producties genomen, waarna [ Geïntimeerde ] een antwoordakte heeft genomen.
Ten slotte hebben partijen arrest gevraagd.

De feiten en de behandeling van grief I
De kantonrechter heeft in het bestreden vonnis onder het kopje “De vaststaande feiten” een aantal feiten, genummerd 1 tot en met 15, als tussen partijen vaststaand aangemerkt. Grief I is gericht tegen de vaststelling onder 8, voor zover inhoudend dat [ Geïntimeerde ] plotseling een voetbal hard tegen haar hoofd kreeg. Vanwege de desbetreffende betwisting door SKO zal het hof er niet van uitgaan dat [ Geïntimeerde ] een bal hard tegen het hoofd kreeg. Overigens is dit aspect, zoals uit het hierna volgende zal blijkenk, voor de beoordeling van de zaak niet van belang. Omdat de door de kantonrechter vastgestelde feiten voor het overige niet in geschil zijn, zal ook het hof daarvan uitgaan.

De (verdere) beoordeling in hoger beroep
3.1. In deze zaak gaat het om het volgende.
(a) SKO verzorgt basisonderwijs voor leerplichtige leerlingen, onder meer door middel van de exploitatie van basisschool Pancratius te Oosterblokker (verder: de school), waarop ongeveer 160 leerlingen zitten, verdeeld over zeven groepen.
(b) [ Geïntimeerde ] is sinds 1 augustus 1993 op arbeidsovereenkomst werkzaam bij SKO. Haar werkzaamheden bestonden ten tijde van na te melden ongeval hoofdzakelijk uit lesgeven. Daarnaast had zij, evenals de overige docenten, toezichthoudende taken, waaronder het surveilleren als pleinwacht tijdens de pauzes.
(c) Het pand waarin de school tot mei 2008 was gevestigd bestond uit een hoofd- en een kleutergebouw, schuin tegenover elkaar gelegen. Beide gebouwen hadden een eigen schoolplein. Deze pleinen...
