   Partijen zullen hierna [eiseres sub 1] en de Stichting (gezamenlijk [eiseres sub 1] c.s.) en de UvA genoemd worden.

1. De procedure

   1.1. Het verloop van de procedure blijkt uit:

   - de dagvaarding van 14 september 2011 met producties,

   - de conclusie van antwoord met producties,

   - het tussenvonnis van 16 mei 2012, waarbij de zaak in de stand waarin deze zich bevond ter verdere behandeling en beslissing is verwezen naar de sector civiel van deze rechtbank,

   - het tussenvonnis van 11 juli 2012, waarin een comparitie van partijen is gelast,

   - het proces-verbaal van comparitie van 14 januari 2013 met de daarin genoemde stukken.

   1.2. Ten slotte is vonnis bepaald.

2. De feiten

   2.1. [eiseres sub 1], geboren op [1960], is een voormalig medewerkster van de UvA. [eiseres sub 1] heeft van 1 mei 1992 tot 1 augustus 1996 en van 1 april 1999 tot 1 februari 2008 bij de Faculteit der Economie en Bedrijfskunde (hierna: de FEB) van de UvA gewerkt. Op

   8 februari 2001 is [eiseres sub 1] gepromoveerd op haar proefschrift “[titel proefschrift]”. Van 1 augustus 2004 tot 1 augustus 2007 heeft [eiseres sub 1] NWO-onderzoek (de VENI-beurs) gedaan bij de onderzoeksgroep Methodologie en Geschiedenis van de Economie, ofwel History and Methodology of Economics (hierna: de onderzoeksgroep HME). Van 1 augustus 2007 tot 1 februari 2008 heeft [eiseres sub 1] in tijdelijke dienst als docent gewerkt bij de FEB, afdeling Algemene Economie. Per 1 februari 2008 is deze aanstelling van rechtswege geëindigd.

   2.2. De Stichting heeft blijkens haar statuten ten doel het bevorderen van emancipatie van vrouwen en het bestrijden van hun discriminatie, in het bijzonder door het bevorderen van grensverleggende jurisprudentie. De Stichting tracht dit doel onder meer te verwezenlijken door het voeren en financieel ondersteunen van juridische procedures.

   2.3. Op 18 maart 2008 heeft de UvA een vacature voor de functie van Universitair Docent (hierna: UD) bij de onderzoeksgroep HME van de FEB geplaatst (hierna: de vacature). De onderzoeksgroep HME (die in 2011 is opgeheven) maakte deel uit van de afdeling Algemene Economie en legde de nadruk op de historische en methodologische studie van de hedendaagse economiebeoefening. De tekst van de vacature luidde, voor zover hier van belang, als volgt:

   “(…) vacancy:

   Assistant Professor in History and Methodology of Economics

   (…)

   Requirements

   Requirements are a PhD in economics, history of (social) sciences, philosophy, or other relevant discipline, the proven ability to initiate and implement research of international standards, the ability to stimulate and encourage the research of others, demonstrated teaching excellence, and the ability (or stated intention) to teach in both Dutch and English. Shortlisted candidates will be asked to present one of their papers at a seminar.

   Job application

   Applicants should send their CV, together with two letters of reference, a research paper and a covering letter indicating how her/his research fits in with the research interests of the group (…)”

   2.4. Op 29 april 2008 heeft [eiseres sub 1] naar aanleiding van de vacature een sollicitatiebrief met CV gestuurd aan de selectiecommissie, bestaande uit de heren prof. [A] (hierna: [A]), dr. [B] en dr. [C]. De sollicitatiebrief van [eiseres sub 1] luidt, voor zover thans relevant, als volgt:

   “(…)

   My research in the field of history and philosophy of economics addresses the role of gender in the history and philosophy of economics; how gender has been constructed in economics in relation to its historical context, and how notions of gender have been structuring economic concepts and economics as a science (…) As such this research can contain a valuable addition to the research conducted at the Research Group. (…)”

   2.5. Per e-mail van 19 mei 2008 heeft [A] aan [eiseres sub 1] bericht:

   “(…)

   I am sorry you were not selected for the position at Amsterdam for which you applied. Yours was a very good application, and the search committee regarded it very highly. But the competition was also very strong, and we were emphasizing experience in teaching history of economic thought. (…)”

   2.6. In totaal waren er vijfentwintig sollicitanten voor de vacature, waarvan zeven vrouwen. Vier mannelijke sollicitanten zijn door de selectiecommissie op de zogenoemde shortlist geplaatst. Uiteindelijk is de sollicitatieprocedure versneld afgerond. Aan de vier sollicitanten die op de shortlist waren geplaatst, is niet gevraagd een presentatie van een paper te houden. De vacature is vervuld door de heer [D], een op dat moment eenendertigjarige kandidaat afkomstig uit [land].

   2.7. In reactie op door [eiseres sub 1] verzochte opheldering over haar afwijzing heeft [A] per e-mail van 21 mei 2008 aan [eiseres sub 1] bericht:

   “(…)

   The search committee based its decision on four selection criteria:

1. Quality of publications

   Here we were particularly interested in whether candidates published in journals, especially in history of economics, and whether candidates’ publications were single-authored

2. Letters of recommendation

3. Teaching experience

   Here we focused on experience in teaching the history of economics, since this is the expected main advanced teaching responsibility

4. Evidence of teaching performance

   Though we thought yours was a very good application, we believed other applications were stronger. (…)”

   2.8. Bij e-mail van 22 mei 2008 heeft [eiseres sub 1] in reactie hierop aan [A] bericht:

   “(…)

   The criteria that I understood from [E] (via [F]) as having been used in this process were slightly different: research related to that of the group, teaching experience, publications and person fitting the group, and that the letters of reference were also looked at very seriously (…)

   It also seems that these criteria seem to fit the advertisement better. (…)”

   2.9. Bij e-mail van diezelfde datum heeft [A] in reactie hierop aan [eiseres sub 1] bericht:

   “(…)

   The criteria I sent you are the ones we used. I do not think there are any differences between them and what you say below. By what you say there you were not the best candidate. (…)”

   2.10. Bij e-mail van 26 mei 2008 heeft [eiseres sub 1], voor zover thans relevant, aan [A] bericht:

   “(…)

   The information I am trying to get at is why I have not been selected and why this young man who has considerably less publications and experience than I, has been selected instead. That I was not the best is not enough of an answer.

   (…)

   The criteria you put on the table (quality of publications, letter of reference, teaching experience and evidence of teaching performance) are not gender neutral, but not only that, they seem to change, they are not consistent with the advertisement and they do not cover the needs of the group. (…)

   When feminist economics is not recognized as a field of research, but even stronger when feminist economists are being punished for their activities in the field or leave because of the unfriendly and uncooperative environment what else to expect than that feminist economists leave economics? (…) Are you not concerned that your whole group consists of men right now? How do you explain that? You have done the history of economics and feminist economics no favor by excluding me from the field of the history of philosophy of economics. (…)”

   2.11. Bij e-mail van 27 mei 2008 heeft [A] aan [eiseres sub 1] bericht, voor zover hier van belang:

   “(…)

   I think you are under a number of misapprehensions, both about the quality of your credentials and about the Amsterdam group [rb: de onderzoeksgroep HME].

   (…)

   your publication list is not very strong in my view. (i) The UD position at Amsterdam is in history of economics. You have no publications in any of the leading history of economics journals. (…) (ii) You have no publications in any of the main methodology and philosophy of economics journals. (iii) Nine of your publications are in Dutch and German journals which are not widely read, not highly ranked, and not related to our fields. (…) (vii) You have two book chapters which are good, the [X] book and the [Y] book, but these are the only authored publications which count for very much for our field. (…)

   So basically from the point of view of the Amsterdam UD position your publication record is weak. You do not publish in our field, nor do you publish in competitive, refereed locations. (…)

   I am not aware of your having teaching experience with respect to history of economics. (…) I also have no indication that you are familiar with most of the history of economics. (…) I had no reason to think you would be prepared to teach the course the new UD needs to teach in the field. (…)

   contrary to your belief we are well aware of the small number of women in science and in our field, and we all wish to promote women whenever we can. In my view, however, this does not imply that one should promote a woman over a more qualified candidate when that candidate is a man, and advance the woman only because she is a woman. (…)”

   2.12. [eiseres sub 1] heeft op 27 juni 2008 een klacht ingediend over de sollicitatieprocedure bij de (toenmalige) [functie] van de FEB, prof. [G] (hierna: [G]). In reactie hierop heeft [G] bij brief van 23 juli 2008, voor zover hier van belang, aan [eiseres sub 1] bericht:

   “(…) De voorzitter heeft aan mij de sollicitatieprocedure en de uitkomsten daarvan nader toegelicht. Ik heb geen onregelmatigheden kunnen...
