IenW/BSK-2020/45189, Hoofddirectie Bestuurlijke en Juridische Zaken; Gelet op de artikelen 9.7.2.1, eerste en tweede lid, en 9.8.2.1, eerste lid, van de Wet milieubeheer; De Afdeling advisering van de Raad van State gehoord (advies van 2 september 2020, nr. W17.20.0269/IV); Gezien het nader rapport van de Staatssecretaris van Infrastructuur en Waterstaat van 2 november 2020, nr. IENW/BSK-2020/207797, Hoofddirectie Bestuurlijke en Juridische Zaken; Hebben goedgevonden en verstaan:
Het Besluit energie vervoer wordt als volgt gewijzigd:AArtikel 3 wordt als volgt gewijzigd:1. In het eerste lid wordt onder vervanging van de punt aan het slot van onderdeel c door een puntkomma een onderdeel toegevoegd, luidende: d. 2021 17,5 procent. 2. In het tweede lid wordt na onderdeel c een onderdeel toegevoegd, luidende: d. voor het kalenderjaar 2021 ten hoogste 5 procent; 3. In het derde lid wordt na onderdeel c een onderdeel toegevoegd, luidende: d. voor het kalenderjaar 2021 ten minste 1,2 procent; BArtikel 35 komt te luiden:
Het percentage, bedoeld in artikel 9.8.2.1, eerste lid, van de wet bedraagt zes procent voor elk kalenderjaar.
Dit besluit treedt in werking met ingang van 1 januari 2021.

NOTA VAN TOELICHTING

Inleiding
Met onderhavige wijziging wordt het Besluit energie vervoer aangevuld met de vaststelling van de hoogte van de jaarverplichting, en de bijbehorende (sub)limieten, voor leveranciers van brandstoffen, voor het kalenderjaar 2021. Daarnaast wordt de reductieverplichting voor brandstofleveranciers ook na kalenderjaar 2020 voortgezet, met de vaststelling van de hoogte van de reductieverplichting van zes procent voor de navolgende kalenderjaren.
Om te voldoen aan de Europese richtlijn hernieuwbare energie1 heeft Nederland in de Wet milieubeheer de systematiek van de jaarverplichting geïntroduceerd.2 Voor deze jaarverplichting zijn in het Besluit energie vervoer de jaarlijkse (opklimmende) percentages vastgesteld van het gedeelte van de energie-inhoud dat leveranciers van benzine en diesel voor vervoer verplicht zijn om jaarlijks te compenseren, met de levering van energie voor vervoer uit hernieuwbare bronnen. De jaarverplichting is in het Besluit energie vervoer vastgesteld voor de kalenderjaren 2018 tot en met 2020. Daarnaast zijn in het Besluit energie vervoer de jaarlijkse percentages vastgesteld voor het deel van de jaarverplichting dat ten hoogste mag worden gecompenseerd met de inzet van conventionele biobrandstoffen (maximale limiet) en het deel van de jaarverplichting dat in ieder geval moet worden gecompenseerd met de inzet van geavanceerde brandstoffen (minimale limiet).
Naast bovengenoemde jaarverplichting in het kader van hernieuwbare energie, bevat het Besluit energie vervoer ter implementatie van de richtlijn brandstofkwaliteit3 ook de vaststelling van het percentage broeikasgasemissie dat leveranciers van brandstoffen in het kalenderjaar 2020 verplicht zijn om over de door hen geleverde benzine en diesel te verminderen (reductieverplichting vervoersemissies).
