Tijdelijke wet notificatieapplicatie covid-19
Wet van 6 oktober 2020, houdende tijdelijke bepalingen in verband met de inzet van een notificatieapplicatie bij de bestrijding van de epidemie van covid-19 en waarborgen ter voorkoming van misbruik daarvan (Tijdelijke wet notificatieapplicatie covid-19)

Allen, die deze zullen zien of horen lezen, saluut! doen te weten:Alzo Wij in overweging genomen hebben, dat het wenselijk is dat wettelijke waarborgen worden opgenomen ter voorkoming van misbruik van een bij de bestrijding van de epidemie van covid-19 mogelijk in te zetten notificatieapplicatie dan wel van enig ander vergelijkbaar digitaal middel; Zo is het, dat Wij, de Afdeling advisering van de Raad van State gehoord, en met gemeen overleg der Staten-Generaal, hebben goedgevonden en verstaan, gelijk Wij goedvinden en verstaan bij deze:
De Wet publieke gezondheid wordt als volgt gewijzigd:ANa artikel 6c wordt een artikel ingevoegd, luidende:

In het kader van de taak van Onze Minister, bedoeld in artikel 3, eerste lid en artikel 7, eerste lid, en voorts ter ondersteuning van de bron- en contactopsporing, bedoeld in artikel 6, eerste lid, onder c, ter bestrijding van de epidemie van covid-19, veroorzaakt door het virus SARS-CoV-2 kan een notificatieapplicatie worden ingezet waarmee vroegtijdig zicht kan worden verkregen op een mogelijke infectie met dat virus door bij te houden welke gebruikers in elkaars nabijheid zijn geweest en hen in voorkomende gevallen te waarschuwen over een mogelijke infectie met het virus. Voor zover noodzakelijk kunnen Onze Minister en de gemeentelijke gezondheidsdiensten bij het beheer en de toepassing van deze notificatieapplicatie persoonsgegevens verwerken, waaronder persoonsgegevens over de gezondheid als bedoeld in artikel 9 van de Algemene verordening gegevensbescherming. 2. In het kader van de notificatieapplicatie worden uitsluitend de volgende gegevens verwerkt: 1° gepseudonimiseerde codes waarmee de nabijheid van gebruikers wordt bijgehouden en gebruikers in voorkomende gevallen worden gewaarschuwd voor een mogelijke infectie met het virus; 2° het pseudo mac-adres van gebruikers; 3° de duur van de nabijheid van gebruikers; 4° de afstand waarbinnen gebruikers in elkaars nabijheid waren; 5° de weging van het risico dat de betreffende gebruiker mogelijk geïnfecteerd is met het virus; 6° het ip-adres van gebruikers; 7° de eerste dag waarop een met het virus geïnfecteerde...
