Wet van 27 september 2019 tot wijziging van enige wetten in verband met de normalisering van de rechtspositie van ambtenaren in het onderwijs
Wij Willem-Alexander, bij de gratie Gods, Koning der Nederlanden, Prins van Oranje-Nassau, enz. enz. enz. Allen, die deze zullen zien of horen lezen, saluut! doen te weten:Alzo Wij in overweging genomen hebben, dat de Eerste Kamer der Staten-Generaal het initiatiefvoorstel van de Wet normalisering rechtspositie ambtenaren heeft aanvaard en het in verband daarmee wenselijk is om wetten aan te passen; Zo is het, dat Wij, de Afdeling advisering van de Raad van State gehoord, en met gemeen overleg der Staten-Generaal, hebben goedgevonden en verstaan, gelijk Wij goedvinden en verstaan bij deze:
WIJZIGING WET NORMALISERING RECHTSPOSITIE AMBTENAREN.
In artikel I van de Wet normalisering rechtspositie ambtenaren wordt artikel 2 als volgt gewijzigd: 1. Voor de huidige tekst wordt de aanduiding «1.» geplaatst. 2. Er wordt een lid toegevoegd, luidende: 2. Geen overheidswerkgever in de zin van deze wet zijn: a. gemeenten, voor zover het betreft de instandhouding van openbare scholen als bedoeld in onderdeel a van de begripsbepaling van openbare school in artikel 1 van de Wet op het primair onderwijs, onderdeel a van de begripsbepaling van openbare school in artikel 1 van de Wet op de expertisecentra, en onderdeel a van de begripsbepaling van openbare school in artikel 1 van de Wet op het voortgezet onderwijs; b. openbare rechtspersonen als bedoeld in artikel 47 van de Wet op het primair onderwijs, artikel 50 van de Wet op de expertisecentra en artikel 42a van de Wet op het voortgezet onderwijs; c. openbare instellingen als bedoeld in artikel 1.1.1, onderdeel c, van de Wet educatie en beroepsonderwijs; d. de openbare instellingen, bedoeld in onderdelen a, h en j, onder 1, van de bijlage behorende bij de Wet op het hoger onderwijs en wetenschappelijk onderzoek; e. de instellingen voor wetenschappelijk onderzoek, bedoeld in artikel 1.5 van de Wet op het hoger onderwijs en wetenschappelijk onderzoek; f. de Nederlandse organisatie voor wetenschappelijk onderzoek, bedoeld in artikel 2, eerste lid, van de Wet op de Nederlandse organisatie voor wetenschappelijk onderzoek; g. de Nederlandse Organisatie voor toegepast-natuurwetenschappelijk onderzoek TNO, genoemd in artikel 3, eerste lid, van de TNO-wet.
WIJZIGING WET OP HET PRIMAIR ONDERWIJS.
De Wet op het primair onderwijs wordt als volgt gewijzigd:AArtikel 1 wordt als volgt gewijzigd:1. In onderdeel a van de definitie van «personeel» in artikel 1 vervalt «of een akte van aanstelling». 2. In onderdeel b van de definitie van «personeel» in artikel 1 wordt «de artikelen 33, 33a, 34, 38, 52, 53, eerste en tweede lid, 59, eerste tot en met vierde lid, 60 tot en met 62, 68, 138 en 139» vervangen door «de artikelen 33, 33a, 34, 34a, eerste lid, 38, 52, 68, 138 en 139». BIn artikel 17 vervalt het vierde lid onder vernummering van het vijfde tot en met tiende lid tot vierde tot en met negende lid. CIn artikel 17c, vierde lid, wordt «de artikelen 29, vijfde lid, 33, 33a, 34, 38, 53, 59, 60 en de daarmee verband houdende wettelijke bepalingen» vervangen door «de artikelen 29, vijfde lid, 33 tot en met 34a, 38, en de daarmee verband houdende wettelijke bepalingen». DArtikel 33 komt te luiden:
Het bevoegd gezag draagt er zorg voor dat de rechtspositie van het personeel wordt geregeld. EIn artikel 34, tweede lid, vervalt «en in de artikelen 53 en 59».FNa artikel 34 wordt een nieuw artikel ingevoegd, luidende:
a. Afschriften bewijsstukken.
