Het geding in eerste aanleg
Voor het geding in eerste aanleg verwijst het hof naar de inhoud van het vonnis van 7 mei 2010 dat de rechtbank Arnhem, sector kanton, locatie Nijmegen (hierna: de kantonrechter) tussen appellant (hierna ook te noemen: [appellant]) als eiser en geïntimeerde (hierna ook te noemen: [geïntimeerde]) als gedaagde heeft gewezen; van dat vonnis is een fotokopie aan dit arrest gehecht.

Het geding in hoger beroep
2.1 Het verloop van de procedure blijkt uit:
- de dagvaarding in hoger beroep d.d. 3 augustus 2010, hersteld bij exploten van 31 augustus en van 6 september 2010 ,
- de memorie van grieven,
- de memorie van antwoord.

De grieven
3.1 [appellant] heeft de volgende grieven aangevoerd.
Grief I: De kantonrechter heeft de vordering van € 4.500,- ten onrechte afgewezen. Gelet op het door [appellant] hierbij overgelegde bewijs van eigendom, zijnde de factuur van de betreffende auto (productie 1), is [appellant] wel degelijk aan te merken als de rechtmatige eigenaar van de betreffende auto.
Grief II: Nu hiermee voldoende aannemelijk is gemaakt dat [appellant] als rechtmatige eigenaar van de auto is aan te merken, heeft hij aldus wel degelijk schade geleden ten gevolge van de onderverzekering welke te wijten is aan [geïntimeerde]. Er is sprake van toerekenbare tekortkoming in de nakoming aan de zijde van [geïntimeerde], van het contract van dienstverlening tussen [geïntimeerde] en [appellant]. [geïntimeerde] is aldus aansprakelijk voor de schade op grond van artikel 6:74 jo 6:98 BW.

De vaststaande feiten
Als enerzijds gesteld en anderzijds niet of onvoldoende betwist, staan vast de door de kantonrechter vastgestelde feiten.

De motivering van de beslissing in hoger beroep
5.1 De zaak gaat over het volgende. [appellant] heeft in september 2007 een autoverzekering bij Fortis ASR afgesloten voor zijn Volkswagen met kenteken [...].
In opdracht van [appellant] heeft [geïntimeerde] nadien bij Fortis ASR een wijziging van de auto voor deze polis doorgevoerd. De verzekerde auto is gewijzigd in een Volkswagen Golf met kenteken [....] (hierna: de auto). Op het polisblad is vermeld dat de auto casco beperkt verzekerd is tegen een bedrag van € 5.000,-. De auto is op 31 januari 2009 gestolen.
Op 2 februari 2009 is hiervan bij de regiopolitie Gelderland-Zuid een proces-verbaal van afgifte opgemaakt waarin als aangever/benadeelde vermeld is: ‘[A.]’. In een verklaring ter zake diefstal voertuig bij CED Forensic heeft [appellant] als eigenaar vermeld ‘[A.] [geboortedatum]’. De waarde van de vermiste VW Golf is vastgesteld op een bedrag van € 9.500,-. Bij brief van 8 april 2009 laat Fortis ASR aan [geïntimeerde] weten dat in verband met het verzekerd bedrag van € 5.000, de schade-uitkering tot deze verzekerde som is gemaximeerd en rekening houdende met eigen risico een bedrag van € 4.850,- rechtstreeks aan verzekerde is overgemaakt. [appellant] verwijt [geïntimeerde] de onderverzekering van de auto en stelt, kort samengevat, dat sprake is van een beroepsfout als assurantietussenpersoon nu [geïntimeerde] hem op deze onderverzekering had moeten wijzen. Op grond van wanprestatie/onrechtmatige daad is [geïntimeerde] aansprakelijk voor de schade ten belope van het...
