de inspecteur van de Belastingdienst, kantoor Den Haag, de Inspecteur,
op het hoger beroep van de Inspecteur tegen de uitspraak van de rechtbank Den Haag van 3 februari 2015, nummer SGR 14/1941, betreffende de hierna vermelde aanslag en beschikking.
De Inspecteur heeft aan belanghebbende een aanslag in de inkomstenbelasting en de premie volksverzekeringen (hierna: IB/PVV) voor het jaar 2008 opgelegd naar een belastbaar inkomen uit werk en woning van € 41.218. Gelijktijdig met de vaststelling van de aanslag heeft de Inspecteur aan belanghebbende bij beschikking heffingsrente tot een bedrag van € 637 in rekening gebracht.
Belanghebbende heeft tegen de aanslag en de beschikking bezwaar gemaakt. Bij uitspraak op bezwaar heeft de Inspecteur de bezwaren ongegrond verklaard.
Belanghebbende heeft hiertegen beroep bij de rechtbank ingesteld. Ter zake daarvan is € 45 griffierecht geheven.
De rechtbank heeft het beroep gegrond verklaard, de uitspraak op bezwaar vernietigd, de aanslag verminderd tot een verzamelinkomen van nihil, de beschikking heffingsrente vernietigd, het bedrag van de niet in aanmerking genomen persoonsgebonden aftrek vastgesteld op € 21.360, bepaald dat haar uitspraak in de plaats treedt van de vernietigde uitspraak op bezwaar, de Inspecteur veroordeeld in de proceskosten van belanghebbende ten bedrage van € 974 en gelast dat de Inspecteur het door belanghebbende betaalde griffierecht van € 45 vergoedt.
De Inspecteur is van de uitspraak van de rechtbank in hoger beroep gekomen bij het Hof. Belanghebbende heeft een verweerschrift ingediend.
De mondelinge behandeling van de zaak heeft plaatsgehad ter zitting van het Hof van 12 augustus 2015, gehouden te Den Haag. Partijen zijn verschenen. Van het verhandelde ter zitting is een proces-verbaal opgemaakt.
Op grond van de stukken van het geding en het ter zitting verhandelde gaat het Hof in hoger beroep uit van de door de rechtbank onder 1 tot en met 9 van haar uitspraak vermelde feiten:
"1. [Belanghebbende] is [in] 1950 geboren. In het onderhavige jaar woonde [belanghebbende] in Nederland. [Belanghebbende] is vóór 1 januari 1995 in dienst getreden van het Europees Octrooibureau (EOB). Het EOB is één van de twee organen van de Europese Octrooi Organisatie (EOO), welke organisatie is opgericht bij het Verdrag inzake de verlening van Europese octrooien (met uitvoeringsreglement en protocollen) van 5 oktober 1973 (hierna: het Europees Octrooiverdrag; EOV, Trb 1975, 108). Het andere orgaan van de EOO is de Raad van Bestuur (Administrative Council).
2. In 1977 heeft Nederland het EOV geratificeerd. Het ‘Protocol on Privileges and Immunities’(het Protocol) is een integraal onderdeel van het EOV. In het EOV zijn onder meer de volgende bepalingen opgenomen:
“Article 4
European Patent Organisation
(1) A European Patent Organisation, hereinafter referred to as
the Organisation, is established by this Convention. It shall have
administrative and financial autonomy.
(2) The organs of the Organisation shall be:
(a) the European Patent Office;
(b) the Administrative Council.
(3) The task of the Organisation shall be to grant European
patents. This shall be carried out by the European Patent Office
supervised by the Administrative Council.
Article 8
Privileges and immunities
The Protocol on Privileges and Immunities annexed to this Convention
shall define the conditions under which the Organisation,
the members of the Administrative Council, the employees of the
European Patent Office and such other persons specified in that
Protocol as take part in the work of the Organisation, shall enjoy, in
each Contracting State, the privileges and immunities
necessary for the performance of their duties.
Article 33
Competence of the Administrative Council in certain cases
(1) (…)
(2) The Administrative Council shall be competent, in conformity
with this Convention, to adopt or amend:
(a) the Financial Regulations;
(b) the Service Regulations for permanent employees and the
conditions of employment of other employees of the European
Patent Office, the salary scales of the said permanent and other
employees, and also the nature, of any supplementary benefits
and the rules for granting them;
(c) the Pension Scheme Regulations and any appropriate increases
in existing pensions to correspond to increases in salaries;
(d) the Rules relating to Fees;
(…)
Article 34
Voting rights
(1) The right to vote in the Administrative Council shall be
restricted to the Contracting States.
(2) Each Contracting State shall have one vote, subject to the
application of the provisions of Article 36.
Article 35
Voting rules
(1) The Administrative Council shall take its decisions other than
those referred to in paragraph 2 by a simple majority of the Contracting
States represented and voting.
(2) A majority of three-quarters of the votes of the Contracting
States represented and voting shall be required for the decisions
which the Administrative Council is empowered to take under
Article 7, Article 11, paragraph 1, Article 33 (…)
(3) Abstentions shall not be considered as votes.”
In het Protocol zijn onder meer de volgende bepalingen opgenomen:
“Article 13
(1) Subject to the provisions of Article 6, the President of the European Patent Office shall enjoy the priviliges and immunities accorded to diplomatic agents under the Vienna Convention on Diplomatic Relations of 18 April 1961 (…)
Article 14
The employees of the European Patent Office:
(a) shall, even after their service has terminated, have immunity
from jurisdiction in respect of acts, including words written and
spoken, done in the exercise of their functions; (…)
Article 16
(1) The persons referred to in Articles 13 and 14 shall be subject
to a tax for the benefit of the Organisation on salaries and emoluments
paid by the Organisation, subject to the conditions and rules
laid down by the Administrative Council within a period of one
year from the date of the entry into force of the Convention. From
the date on which this tax is applied, such salaries and emoluments
shall be exempt from national income tax. The Contracting States
may, however, take into account the salaries and emoluments thus
exempt when assessing the amount of tax to be applied to income
from other sources.
(2) Paragraph 1 shall not apply to pensions and annuities paid
by the Organisation to the former employees of the European Patent
Office.
Article 17
The Administrative Council shall decide the categories of employees
to whom the provisions of Article 14, in whole or in part,
and Article 16 shall apply and the categories of experts to whom
the provisions of Article 15 shall apply.
The names, titles and addresses of the employees and experts included
in such categories shall be communicated from time to time
to the Contracting States.”
3. In juli 2003 is [belanghebbende] arbeidsongeschikt geraakt. Hierna heeft [belanghebbende] geen werkzaamheden meer voor het EOB verricht. Vanaf juli 2003 tot 1 januari 2008 ontving [belanghebbende] inkomen van het EOB. Dit betrof een ‘invalidity pension’ (invaliditeitspensioen) verstrekt op grond van de toen geldende pensioenregeling voor invaliden van het EOB. Dit invaliditeitspensioen was niet onderworpen aan een belasting ten gunste van de EOO (interne belastingheffing). Hierover werd in Nederland inkomstenbelasting geheven.
4. De relevante regelgeving van het EOB luidde tot 1 januari 2008 als volgt:
“Service Regulations for permanent employees of the European Patent Office (het Ambtenarenregelement)
Section 3 Retirement
Article 54
Date of retirement
(1) A permanent employee shall be retired
- automatically on the last day of the month during which he reaches the age of sixty-five years
- at his own request under the conditions stipulated in the Pension Scheme Regulations.
(2) A permanent employee found to fulfil the conditions for invalidity set out in Article 13 of the Pension Scheme Regulations shall cease to perform his duties and shall receive an invalidity pension.”

INVALIDITY PENSION
Article 13
Conditions of entitlement - Medical Committee
(1) Subject to the provisions of Article 2, an invalidity pension shall be payable to
an employee who is under the age limit laid down in the Service Regulations
and who, at any time during the period in which pension rights are accruing
to him, is recognised as meeting the definition of invalidity.
(2) “Invalidity” means physical and/or psychological incapacity making it
definïtively and permanently impossible for the employee concerned to
carry out, at least on a 50% part-time basis, his duties or similar other
duties which might reasonably be assigned to him, ie which correspond
to his situation, his knowledge and his capabilities.
(3) Such incapacity must be established by the Medical Committee referred
to in Article 89 of the Service Regulations.
Article 16
Medical examination - Termination of pension
(1) While an employee drawing an invalidity pension is still under the age limit
laid down in the Service Regulations, the Office may have him medically
examined periodically to ascertain that he still satisfies the conditions for entitlement to such pension.
